This contact is for copyright matters only. For other questions, write to info@keryxtv.com.
2. How to submit a notice of infringement
Under 17 U.S.C. § 512(c)(3), your written notice must include:
- Identification of the copyrighted work you claim has been infringed (or, for multiple works, a representative list).
- Identification of the material claimed to be infringing that you want removed, with information reasonably sufficient to locate it, including the URL or the program name, channel, and air date and time.
- Your contact information: name, mailing address, phone number and email address.
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.
- Your physical or electronic signature (or that of the authorized person).
Send the notice to the designated agent above. A notice that does not substantially comply with these requirements may not be effective. Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages.
3. Counter-notice
If material you posted or submitted was removed and you believe it was removed by mistake or misidentification, you may send a written counter-notice to the designated agent. Under 17 U.S.C. § 512(g)(3), it must include:
- Identification of the material that was removed or disabled and the location where it appeared before removal (for example, the URL or program).
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address and phone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district of your address (or, if your address is outside the United States, any judicial district in which Keryx TV may be found), and that you will accept service of process from the person who submitted the original notice or that person's agent.
- Your physical or electronic signature.
When we receive a valid counter-notice, we will send a copy to the person who submitted the original notice. We will restore the material 10 to 14 business days after receiving the counter-notice, unless we first receive notice that the person has filed a court action seeking to restrain the allegedly infringing activity.
4. Repeat infringer policy
In appropriate circumstances, Keryx TV will terminate the accounts, service access and programmer-portal upload links of repeat infringers. We may also remove or stop airing any program or material at our discretion.
